The seller of the goods offered on this website is SIA “EM-JAY” (registration No. LV40103848411, address – Duntes iela 7, 2B, Rīga, LV-1012), hereinafter referred to as the Seller, on one side, and a natural or legal person who wishes to purchase, purchases, or may purchase goods, hereinafter referred to as the Buyer, on the other side, conclude the following Agreement:
Before starting to use the Seller’s website www.komandabasketball.lv (hereinafter – the Website), please read these Terms of Use carefully. These terms apply to all users of the Website (hereinafter – the Users). The use of the Website is considered confirmation that the Users have fully read, understood, and agree to comply with the Terms of Use (hereinafter – the Terms).
1. Seller’s Rights and Obligations

The Seller has the right to change the content or conditions of the Website at any time, as well as any information provided by the Buyer.

The Buyer agrees that the Seller is not responsible for any negative consequences such actions may cause and waives any claims in this regard.

The Seller has the right, without prior notice or consent, to block the Buyer’s access to the Website to protect the rights and legitimate interests of other persons or to comply with legal requirements.
2. Buyer’s Rights and Obligations

The Buyer must comply with these Terms, not infringe the rights of the Seller or third parties, provide true information about themselves, use secure electronic communication and data transmission tools, and not spread viruses that could interfere with the Website.

The Buyer must immediately inform the Seller if they become aware that their data is or may be used by third parties.
3. Delivery and Payment Procedures

The Buyer orders goods through the Website, specifying the product model and quantity.

The Buyer can pay for the goods using the payment tools integrated on the Website or by paying the invoice prepared and sent by the Seller to the Buyer by e-mail. The invoice is prepared electronically and is valid without a signature.

The Seller provides delivery of goods within one month if the goods are not in the store-warehouse. Goods can be picked up at the store-warehouse during working hours.

For goods available in stock, delivery to the Buyer’s specified address will be ensured within one calendar week.

The purchase confirmation document, when goods are delivered to the Buyer’s specified address, is the order document sent to the Buyer’s e-mail at the time of purchase.

The fact that the Buyer has received the goods is confirmed by the Buyer’s signature on the courier’s delivery note at the time of delivery.
4. Payment

Payment can be made via non-cash transfer using a Visa or MasterCard payment card.

Cash: pay in cash upon collection at our store-warehouse (Duntes iela 7, 2B, Rīga, LV-1012) or upon delivery (if selected).

Leasing: goods can be purchased on installment via our website or in-store.

Internet banking: pay through your online bank using our e-commerce payment options.

Bank transfer: pay according to the invoice issued by the Seller.

Bank card: pay by card at our store-warehouse.
5. Right of Withdrawal

The Buyer has the right to withdraw from the purchase within 14 calendar days from the date of receiving the goods by sending a withdrawal letter to the Seller.

The Seller will send the withdrawal form to the Buyer via e-mail upon request or provide a downloadable link on the Website.

The Buyer must return the goods to the Seller within 7 days after sending the withdrawal letter.

All return shipping costs are covered by the Buyer. Returned goods must be delivered to Duntes iela 7, 2B, Rīga, LV-1012, and be in full set and original condition.

Refunds will be made within five business days after the goods are returned, using the same payment method originally used.

The Buyer cannot exercise the right of withdrawal if:

the product’s material is damaged due to improper use;
-
the goods were custom-made for the Buyer;
-
mechanical parts of the goods were damaged due to the Buyer’s fault.

According to Article 12(6) of the Consumer Rights Protection Law of the Republic of Latvia, the consumer is responsible for maintaining the quality and safety of the product during the withdrawal period. The Seller reserves the right to deny withdrawal or withhold compensation if the goods are damaged, used carelessly, missing original packaging, or if the packaging is significantly damaged.
6. Copyright

The content of the Website (including original texts, photos, videos, etc.) is copyrighted by the Seller or third parties who have granted permission for publication.

It is prohibited to reproduce, sell, copy, adapt, or otherwise use any Website content without the Seller’s permission.
7. Legal Relations

Legal relations arising from these Terms are governed by the laws of the Republic of Latvia.
8. Data Processing

By entering the necessary information and placing an order on the Website, the Buyer confirms that they are aware and agree that their data will be collected, used, processed, and stored by the Seller in accordance with Latvian legislation to fulfill the order and deliver the goods.

By entering information, the Buyer agrees to receive e-mails related to their order processing.
9. Data Collection and Use

Personal data refers to information that the Seller obtains from the Buyer with consent in order to fulfill the purchase agreement and maintain communication.

Buyer data is collected when the Buyer provides contact information (name, surname, personal ID number, address, phone number, e-mail) on the Website or during a purchase.

All personal data held by SIA “EM-JAY” will be deleted upon request by the data subject, submitted in writing to info@komandabasketball.lv.

The Buyer has the right, upon written request, to receive information about:
